1. Who we are
High Performance Matters (Pty) Limited, also known as HPM, is a South African-based business providing leadership development, coaching, mentoring, consulting, facilitation, training and related services to organisations and individuals across South Africa and Africa. This Privacy Policy explains how HPM collects, uses, stores, shares and protects personal information. For the purposes of South African privacy law, HPM is generally the Responsible Party for the personal information it collects and decides how to use.
2. Who this policy applies to
This policy applies to personal information we collect from: clients and prospective clients; people who participate in HPM coaching, mentoring, leadership, training or development programmes; people who are nominated, sponsored or referred by their employer, client organisation, funder or another third party; people participating in programmes outside of their employer group or outside of a client organisation; suppliers, service providers and business partners; visitors to our website or social media pages; people who contact us, attend events, complete forms or surveys, or subscribe to our communications; and anyone else whose personal information we process in the ordinary course of our business. Where a company, group, sponsor or other organisation appoints us to provide coaching, mentoring, training or development services to its people, we may receive personal information from that organisation. We may also collect information directly from the individual participant.
3. What personal information we collect
Depending on your relationship with HPM, we may collect: Identity information: name, surname, title, role, organisation, job title and professional profile. Contact information: email address, telephone number, business address, country and communication preferences. Programme information: programme registration details, attendance, participation records, feedback, assessment inputs, mentoring or coaching goals, development plans and progress notes. Business information: company name, role, industry, project information, proposal history, contract details and client relationship information. Payment and administration information: billing details, purchase orders, VAT or tax information and payment records. Marketing and communication information: newsletter preferences, event attendance, communication history and areas of interest. Technical and website information: IP address, browser information, device information, usage data, cookie data and website analytics. Special or sensitive personal information: only where necessary and lawful, for example dietary needs, accessibility requirements, demographic information required for a specific programme, or information voluntarily shared in a coaching, mentoring or development context. We aim to collect only the information we need for a clear business, legal, contractual, programme-related or legitimate purpose.
4. How we collect personal information
We may collect personal information: directly from you when you contact us, complete a form, join a programme, attend a session, subscribe to communications or communicate with us; from your employer, sponsor, nominating organisation, programme partner or client organisation; from publicly available sources such as LinkedIn, company websites or professional directories; from service providers who support our work; and through our website, email systems, online forms, surveys, CRM systems, analytics tools, cookies and similar technologies. 5. Why we use personal information
HPM may use personal information to: provide coaching, mentoring, leadership development, consulting, training and related services; manage programme applications, enrolment, attendance, participation and reporting; communicate with participants, clients, sponsors, funders and programme partners; understand participant goals, development needs, learning outcomes and programme impact; prepare proposals, contracts, invoices, project documentation and client reports; manage client, supplier and partner relationships; run events, workshops, webinars, meetings and surveys; improve our services, content, tools and programmes; send relevant updates, invitations, insights, articles or marketing communications, where lawful; manage our website, digital platforms, forms, CRM and communication systems; comply with legal, tax, reporting, accounting and regulatory obligations; protect our rights, property, systems and business interests; detect or prevent fraud, misuse, security incidents or unlawful activity; and keep appropriate records for business, contractual, legal or dispute-resolution purposes.
6. Coaching and mentoring confidentiality
HPM understands that coaching and mentoring can involve personal, professional and sensitive discussions. As far as reasonably possible, HPM treats individual coaching and mentoring information as confidential. Where HPM is appointed by an employer, sponsor, client or programme partner, we may provide appropriate programme-level reporting. This may include attendance, participation, progress themes, completion, aggregated insights or agreed outcomes. Unless otherwise agreed, HPM will avoid sharing detailed personal coaching or mentoring notes with an employer, sponsor or third party without the participant’s knowledge or consent, except where required by law, necessary to protect safety, or needed to address a serious risk, legal obligation or contractual requirement.
7. When we may share personal information
HPM does not sell personal information. We may share personal information where necessary with: employees, directors, consultants, coaches, mentors or facilitators working with HPM; the client, employer, sponsor, funder or programme partner who has appointed HPM, but only to the extent appropriate for the programme, service or contract; service providers such as IT, cloud storage, website, email, CRM, finance, legal, accounting, design, survey, research, marketing or administration providers; professional advisers, auditors, insurers or legal representatives; regulators, public authorities, courts or law enforcement bodies where required by law; another business entity if HPM is involved in a merger, sale, restructure or transfer of business; and other parties where you have consented or where the law allows us to do so. Where service providers process personal information for HPM, we will take reasonable steps to ensure they protect it and use it only for authorised purposes.
8. Website tools, digital platforms and third-party services
HPM may use digital tools and platforms to operate our business, communicate with clients and participants, manage programmes, analyse website performance and improve our services. These may include, but are not limited to: Google Analytics; Meta Pixel; LinkedIn Insight Tag; Mailchimp; Microsoft Forms; HubSpot; Zoho; Canva; OneDrive; SharePoint; and similar business, analytics, marketing, design, cloud, CRM and administration tools. These tools may collect or process personal information such as contact details, website usage information, device information, communication preferences, form responses, analytics data or engagement information. Some of these providers may store or process information outside South Africa. Where we use these tools, we take reasonable steps to ensure that personal information is processed lawfully, securely and for appropriate business purposes.
9. Working across South Africa and Africa
HPM operates from South Africa and may work with clients, participants, coaches, mentors, facilitators, suppliers and service providers in other African countries and elsewhere. This means personal information may be transferred, stored or accessed outside South Africa. Where this happens, HPM will take reasonable steps to ensure that personal information is protected through suitable safeguards, contractual terms, confidentiality obligations, secure platforms or other lawful transfer mechanisms.
10. Cookies and website information
Our website may use cookies, pixels, tags and similar technologies to: make the website work properly; understand how visitors use the website; improve website content and user experience; measure marketing and communication effectiveness; and support relevant digital advertising or remarketing. These technologies may be provided by HPM or by third-party platforms such as Google, Meta, LinkedIn or similar service providers. You can usually manage or disable cookies through your browser settings. If you disable cookies, some website functions may not work properly. HPM does not currently publish a separate Cookie Policy. This section forms part of our Privacy Policy.
11. Direct marketing
HPM may send you relevant updates, invitations, insights, articles, programme information or information about our services where permitted by law. You can opt out of direct marketing at any time by using the unsubscribe option in our communication or by contacting us at: info@highperformancematters.com Once you opt out, we will stop sending you direct marketing, although we may still send necessary administrative, contractual, programme or service-related messages.
12. How we protect personal information
HPM uses reasonable technical and organisational safeguards to protect personal information from loss, misuse, unauthorised access, disclosure, alteration or destruction. These safeguards may include: access controls; password protection; secure cloud storage; confidentiality obligations; restricted access to personal information; secure business systems; reasonable supplier controls; and internal procedures for handling personal information. No system is completely secure, but HPM will take reasonable steps to protect personal information and respond appropriately to suspected or actual data breaches.
13. How long we keep personal information
HPM keeps personal information only for as long as reasonably necessary for the purpose for which it was collected, unless a longer period is required or allowed by law, contract, legitimate business need, reporting requirement or dispute-resolution requirement. When personal information is no longer needed, HPM will take reasonable steps to delete, destroy, de-identify or securely archive it.
14. Your rights
Subject to applicable law, you may have the right to: ask what personal information HPM holds about you; request access to your personal information; ask HPM to correct or update inaccurate, incomplete or outdated information; object to certain processing of your personal information; withdraw consent where processing is based on consent; ask HPM to delete personal information where lawful and appropriate; ask HPM to restrict or stop certain processing; and lodge a complaint with HPM or with the relevant privacy regulator. We may need to verify your identity before responding to a request.
15. Children and young people
HPM’s website and services are not aimed at children. If HPM processes personal information relating to a child or minor as part of a specific programme, we will do so only where lawful and with the necessary consent or authority from a competent person, parent, guardian, school, sponsor or other authorised party, as applicable.
16. Third-party websites and platforms
Our website, emails, social media pages or digital communications may contain links to third-party websites, platforms or tools. HPM is not responsible for the privacy practices, security or content of those third-party sites or platforms. You should review their privacy policies before providing personal information to them.
17. No separate PAIA Manual or Cookie Policy
HPM does not currently publish a separate PAIA Manual or Cookie Policy on its website. This Privacy Policy is intended to provide a clear, practical explanation of how HPM handles personal information, website information, cookies and related digital tools.
18. Changes to this policy
HPM may update this Privacy Policy from time to time. The latest version will be made available on our website or on request. Where changes are material, we will take reasonable steps to bring them to your attention.
19. Governing law
This Privacy Policy is governed by the laws of the Republic of South Africa. Where HPM works in other African countries, additional local privacy or data protection laws may also apply.
